This general principle is subject to one exception.
The Act says that less favourable treatment of a disabled person in this regard will be justified only if the qualifications body can show that the standard is (or would be) applied equally to everyone who do not have the disabled person’s disability and that its application is a proportionate means of achieving a legitimate aim..
